KAMPALA– Eron Kiiza, Human Rights Lawyer who was sentenced to nine months imprisonment by Makindye General Court Martial has formally appealed against both his conviction and sentence.
In his memorandum of Appeal filed through his lawyers of Arinaitwe Peter and Company Advocates , Kiiza and Mugisha Company Advocates, the appellant has based his appeal on five grounds.
“The Chairman of the General Court Martial erred in Law and fact when he convicted and sentenced the Appellant without formally charging him thus occasioning a miscarriage of Justice, the Chairman of the General Court Martial erred in Law and fact when he convicted and sentenced the Appellant unheard.”
That the Chairman of the General Court Martial erred in Law and fact when he held that the Appellant was warned on two occasions whereas not.
“The Chairman of the General Court Martial erred in Law and fact when he held that the Appellant had assaulted the Court orderly whereas not.” States Kiiza’s Memorandum of Appeal filed on 5th January 2025
Lastly, that the Chairman of the General Court Martial erred in Law when he sentenced the Appellant to an illegal, harsh and excessive sentence.
On 7th January 2025 , Makindye General Court Martial convicted Counsel Eron Kiiza, one of the lawyers representing Dr. Kiiza Besigye and Hajji Obeid Lutale on Charges of contempt court, he was later sentenced to nine months sentence at Kitalya Prison.
This decision was received with mixed reactions from legal practitioners and members of the general public. Some of these described it as persecution or instilling fear with the defence lawyers.
