Nakawa Magistrates court remands Five over March to Parliament Demonstrations

KAMPALA- Nakawa Chief Magistrate court has charged five individuals with charges of Common Nuisance and Idle and Disorderly in relation with March to Parliament demonstration that took place in various parts of Kampala.

The four included:Thomas Kanzira a doctor and resident of Kiwatule Village , Nakawa Division, Kampala District, Faiza Salima , Journalist working with Nation Media Group, Olupot Bernard Elwawu, Marketeer , Hamala Edgar Barlow and Aljab Musinguzi a resident of Kitintale , Nakawa District in Kampala District.

These have denied the charges brought against them.

They have been remanded to Luzira Prison until 30th July 2023 when they are expected to return to court for bail application and mentioning of their case.

Prosecution contends that five accused with others still at large, at Oasis Mall Nakumatt in Kampala District did an act of gathering together while shouting Anita Among must resign and littering placards bearing the same words outside Nakumatt thereby causing annoyance, obstruction or inconvenience to the public in exercise of common rights.

Its further alleged that the accused persons with others still at large at Oasis Mall in Kampala district conducted themselves in a manner most likely to lead to bleach of peace.

In the meantime, several legal brains on various platforms have started questioning the legality of the Idle and Disorderly Charge having been outlawed

In December 2022, Constitutional Court has nullified section 168 (1) (c and d) of the Penal Code Act that creates an offence commonly known as being Idle and disorderly.

In a lead judgment written by Justice Fredrick Egonda Ntende, the five-judge panel held unanimously that the law was null and void because it infringes on a number of constitutional provisions.
