Kenya High court halts an order banning demonstrations in Nairobi

NAIROBI -Hon.Bahati Mwamuye , a high court judge in Kenya has issued an order staying the implementation of an order by Douglas Kanja Kirocho, the Acting Inspector General of Kenya National Police banning demonstrations with in Nairobi Central Business District and neighboring districts over several reasons.

Among the reasons which Police relied on to ban these demonstrations is that the youths (GenZs) have no clear leadership to work with law enforcement officers which has given criminals a lee way to rob and loot people’s property.

In the court decision, delivered on Thursday in an application treated as a matter of urgency , Hon Bahati issued an order to the staying the orders of the Acting IGP until the application challenging the same before court is fully heard and disposed off.

“Pending the inter-parties hearing of the Application dated 18/07/2024, a conservatory order and is hereby issued restraining the Inspector-General of Police and all other within the National Police Service, or acting in support of the National Police Service in the discharge of law enforcement function. From applying or enforcing the Inspector General’s impugned decision of 17/7/2024.”

The Applicants have been ordered to serve the respondents with the application before closure of business today.

“The Acting Inspector-General of Police shall circulate or cause to be circulated official communication of Orders 2 and 3 above to all Officers of the National Police Service.”

The respondents will serve the applicants with their response by close of business for Judiciary Kenya on 24th July 2024.
