KAMPALA – High Court Judge Dr. Douglas Singiza has dismissed an Habeas corpus Application which was filed by Col. (Rtd) Dr. Kiiza Besigye and his aide Hajji Obeid Lutale challenging their continued detention in Prison on charges by General Court Martial after Supreme court ruling.

The majority decision of Supreme court justices, they outlawed the trial of civilians in the General Court Martial which left Besigye and his aide on remand without valid remand warrant.
Having spent a number of days in prison without a clear outstanding charge against them, these petitioned High Court seeking for their unconditional release from the illegal detention.
“Under section 56 of the Evidence Act Cap. 8, this court is enjoined to take judicial notice of the proceedings of 21 February 2025 in the Chief Magistrates Court of Nakawa at Nakawa in criminal Case No. 285/2025, in which the applicants were formally charged in the courts of law and remanded. While the court would have wished to answer the issues raised, it would be moot for it to do so. Accordingly, the application is dismissed with no orders as to cost.” Ruled Court
On Friday, Nakawa Magistrates Court charged Dr. Besigye and other two co accused with Treason and he was remanded to Luzira Prison up to next month.
Prosecution contends that Kiiza Besigye, Hajji Obeid Lutale, Captain Dennis Oola and others still at large between the year 2023 and November 2024 at various places including Geneva in Switzerland, Athens in Greece, Nairobi in Kenya, Kampala in Uganda, knowing that another person intended to commit treason, did not give information thereof with all reasonable dispatch to the Minister, an administrative officer, a Magistrate or an officer in charge of a police Station or use all reasonable endeavors to prevent the commission of the treason.
