Mukono Grade one Magistrate Paul Matyama has issued an order directing all the children presumed be the late Mohamed Bazinduse Lulibedda Mutumba (Mabirizi’s biological father) to under go DNA test so as to establish their degree of relationship.
“There is no necessity to have the late Mohamed Bazinduse Lulibedda Mutumba exhumed when there are ‘siblings’ all claiming to be children of the deceased who are alive and yet a DNA relationship test will determine even the closest relation there is amongst the children and this will resolve the wrangles in the family.” court ruled
The trial Magistrate dismissed Mabirizi’s prayers for costs , he ordered the DNA test to be financed by the deceased’s estate.
Earlier on Lawyer Hassan Male Mabirizi dragged to court nine of his siblings led by Pastor Solomon Male as respondents in an application seeking for an exhumation order for the remains
of Mohamed Bazinduse Lulibedda Mutumba who was buried on 21st June 2021 at Kasana Village, Ndese Township/ Parish, Seeta-Namuganga Sub county, Mukono District.
In this Mabirizi was seeking court to order for a DNA test to be carried on the remains of the deceased , Mabirizi and other children to establish the real children of Bazinduse
The respondents in their response told court that the late Mohamed Bazinduse Lulibedda Mutumba left a will that the applicant claims to have challenged but There is however no proof of such challenge that was brought before Court
They therefore added that having not mentioned the applicant as one of his children, it is thus the duty of court to determine whether the fact warrants the exhumation of the deceased and having a DNA test carried out to prove paternity of the children or not.
